This License Agreement governs the use of all digital images and wallpapers purchased from MoodVista.art. By purchasing or downloading any image from our website, you agree to be bound by the terms of this agreement.
1. Grant of License
Upon successful purchase and download, MoodVista.art grants you a non-exclusive, non-transferable, perpetual, and revocable license to use the purchased digital image(s) solely in accordance with this agreement.
2. Permitted Uses (Personal Use Only)
You may use the images for personal and non-commercial purposes only, including but not limited to:
- Personal computer, phone, or tablet wallpapers/backgrounds
- Personal blogs or personal websites (non-monetized)
- Personal social media accounts
- Personal projects, presentations, or school assignments
- Printing for personal decoration (e.g., home posters, phone cases for your own use)
3. Prohibited Uses
You are strictly prohibited from:
- Any commercial use whatsoever (including but not limited to advertising, marketing, product design, packaging, or selling goods/services)
- Reselling, redistributing, sublicensing, sharing, or transferring the images to any third party
- Using the images in any digital product intended for sale (e.g., other background packs, templates, stock image collections, NFTs, etc.)
- Incorporating the images into merchandise for sale (physical or digital)
- Printing the images for commercial resale or distribution
- Claiming ownership or copyright of the images
- Using the images in a way that competes with MoodVista.art
- Modifying the images and then reselling or redistributing them
4. Intellectual Property
All images remain the exclusive property of MoodVista.art and/or its contributors. The purchase does not transfer any copyright or ownership rights. All rights not expressly granted in this agreement are reserved by MoodVista.art.
5. License Termination
Your license will automatically terminate if you violate any term of this agreement. Upon termination, you must immediately:
- Delete or destroy all copies of the images
- Cease all use of the images
We reserve the right to pursue legal remedies for any unauthorized use.
6. No Refunds for License Violations
If your license is terminated due to violation of these terms, no refund will be issued.
7. Disclaimer
The images are provided “as is”. We make no warranties regarding compatibility with specific software or devices, or regarding the accuracy of colors on different screens.
8. Limitation of Liability
To the maximum extent permitted by law, MoodVista.art shall not be liable for any damages arising from your use or inability to use the licensed images.
9. Governing Law
This License Agreement is governed by the laws of the Republic of Ireland. Any disputes shall be resolved exclusively in the courts of the Republic of Ireland.
10. Changes to this Agreement
We may update this License Agreement from time to time. Your continued use of the purchased images after such changes constitutes acceptance of the updated terms.
